1. Eligibility

You must be legally capable of entering into these Terms.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.

Notify Perfect Links Fitness promptly if you believe your account has been accessed without authorization.

2. The Perfect Links Fitness Platform

Perfect Links Fitness may provide features including:

• Fitness and activity tracking
• Running and cycling tracking
• Workout programs and training tools
• AI-powered fitness and wellness features
• Challenges, achievements, badges, streaks, XP, levels, wins and losses
• Social feeds and Fitness Wall features
• Stories, posts, comments, likes, messaging and other community features
• Run clubs, fitness groups and community activities
• Personal trainer discovery and booking
• Dietitian or nutrition professional discovery and booking
• Meal, restaurant or grocery-related services
• Supplements, merchandise and fitness products
• Advertising and sponsored content
• Subscription services
• Employer or wellness-program integrations
• Insurance-related administrative functionality where available
• Third-party integrations and connected fitness services
• Other features introduced from time to time

Features may vary by location, device, subscription, eligibility, partner availability or applicable law.

We may add, modify, suspend or discontinue features as the platform evolves.

3. Fitness and Medical Disclaimer

Perfect Links Fitness is primarily a technology and fitness platform.

Unless explicitly stated otherwise, Perfect Links Fitness itself is not a medical provider, physician, hospital, dietitian, physical therapist, pharmacy, insurance company or emergency medical service.

Information provided through the Services is intended for general fitness, wellness and informational purposes and is not a substitute for professional medical advice, diagnosis or treatment.

Always consult an appropriately qualified healthcare professional regarding medical conditions and before beginning or materially changing an exercise, nutrition or wellness program, particularly if you have health concerns.

Do not disregard professional medical advice because of information provided through Perfect Links Fitness.

If you believe you are experiencing a medical emergency, contact emergency services immediately.

4. Assumption of Fitness-Related Risk

Physical exercise involves inherent risks, including falls, collisions, dehydration, overexertion, muscle injuries, cardiovascular events and other injuries.

Outdoor activities may involve additional risks from vehicles, traffic, weather, terrain, animals, other individuals and environmental conditions.

By voluntarily participating in fitness activities, you acknowledge these inherent risks and remain responsible for determining whether an activity is appropriate for you.

You should stop exercising and seek appropriate medical attention if you experience symptoms that may indicate a medical problem.

Nothing displayed within the Services guarantees that an exercise, route, challenge or training program is safe or appropriate for a particular person.

5. AI Trainer and AI-Generated Information

Perfect Links Fitness may provide artificial-intelligence-powered features, including training recommendations, workout suggestions, nutrition-related information, performance analysis, coaching, motivation or other generated content.

AI-generated information may be inaccurate, incomplete or inappropriate for your individual circumstances.

AI features do not replace a qualified physician, registered dietitian, licensed healthcare professional, certified trainer or other appropriate professional.

Users are responsible for evaluating AI-generated recommendations before acting on them.

Perfect Links Fitness does not guarantee specific fitness, health, performance, weight-loss, muscle-gain or other results from AI-generated recommendations.

6. Professionals on the Platform

Perfect Links Fitness may allow users to locate, communicate with, schedule or purchase services from independent personal trainers, dietitians, nutrition professionals, coaches or other service providers (“Professionals”).

Unless expressly stated otherwise, Professionals are independent providers and are not employees of Perfect Links Fitness.

Professionals are responsible for the services they provide and for maintaining licenses, certifications, insurance or credentials required by applicable law.

Perfect Links Fitness may implement credential-verification procedures, but verification does not constitute a guarantee regarding the quality, safety or suitability of a Professional.

Users should independently determine whether a Professional is appropriate for their needs.

7. Insurance and Benefit Services

Certain Services may assist users or Professionals with eligibility inquiries, benefit information, claims-related information, reimbursement workflows or other insurance-related administrative functions.

Availability depends on participating insurers, employers, healthcare organizations, benefit programs, Professionals and other third parties.

Perfect Links Fitness does not guarantee insurance coverage, eligibility, claim approval, reimbursement, payment amounts, benefit availability, or accuracy of information supplied by third parties.

Any coverage information displayed through the Services should be confirmed with the applicable insurer, benefit administrator or healthcare provider.

A user’s financial responsibility may change based on deductibles, copayments, coinsurance, exclusions, coverage limitations and other plan terms.

8. Subscriptions

Perfect Links Fitness may offer free and paid membership plans.

The applicable price, billing period and included features will be disclosed before purchase.

Unless otherwise disclosed at purchase, recurring subscriptions automatically renew until canceled.

You authorize the applicable payment provider to charge the payment method associated with your account for recurring subscription fees, applicable taxes and other authorized charges.

You may cancel a subscription using the cancellation method provided through the platform or the applicable app marketplace.

Cancellation generally prevents future renewals and does not retroactively refund previously paid subscription periods except where required by law or expressly stated otherwise.

Subscription prices and features may change. When required by law, we will provide appropriate advance notice before a material pricing change takes effect.

9. Apple App Store and Google Play Purchases

If you purchase a subscription or digital service through a third-party application marketplace, billing, cancellation and refunds may also be governed by that marketplace’s rules.

Perfect Links Fitness cannot control payment processing performed directly by Apple, Google or another marketplace provider.

Users should manage marketplace subscriptions through the account associated with the relevant marketplace where required.

10. Products, Supplements and Merchandise

Perfect Links Fitness may sell or facilitate the sale of supplements, apparel, accessories and other products.

Product descriptions are provided for informational purposes.

Statements regarding dietary supplements have not necessarily been evaluated by the U.S. Food and Drug Administration.

Supplements are not intended to diagnose, treat, cure or prevent disease unless specifically authorized under applicable law.

Users should review ingredients, warnings, allergens, directions and product labeling before consumption.

Consult an appropriate healthcare professional before taking a supplement if you have a medical condition, use medication, are pregnant or nursing, or otherwise have concerns about whether a product is appropriate for you.

11. Food, Meal and Grocery Services

Perfect Links Fitness may allow users to discover or order meals, groceries or other products from third-party merchants.

Restaurants, grocery stores, meal-preparation businesses, delivery providers and other merchants are responsible for the products and services they provide.

Perfect Links Fitness cannot guarantee that food is free from allergens or cross-contamination.

Users with food allergies or dietary restrictions should communicate directly with the applicable merchant when necessary.

Delivery estimates may be affected by merchant preparation, traffic, weather, delivery-provider availability and other circumstances outside our control.

12. Third-Party Services

The Services may connect with third-party products and platforms, including payment processors, mapping providers, wearable devices, fitness services, delivery providers, healthcare-related technology providers and other integrations.

Your use of third-party services may be governed by separate terms and privacy policies.

Perfect Links Fitness is not responsible for the independent acts, omissions, availability or policies of third-party services except as required by law.

13. Location and Fitness Tracking

Certain features may use GPS, motion, device sensors or other information to record workouts, routes, distance, speed or related activity.

Location and sensor information may occasionally be inaccurate or unavailable.

Do not rely on Perfect Links Fitness maps or navigation features as your sole method of navigation or emergency assistance.

Users are responsible for remaining aware of their surroundings and obeying traffic, property and safety laws.

Never interact with the application in a manner that creates an unsafe distraction while driving, cycling or participating in another activity.

14. Run Clubs, Events and Community Activities

Users may create, organize, discover or participate in run clubs, workouts, challenges, meetups or other activities.

Unless Perfect Links Fitness expressly identifies itself as the organizer, user-created events are independently organized activities.

Participation is voluntary.

Users should exercise reasonable judgment when meeting people through the platform and when participating in physical activities.

Event organizers are responsible for obtaining any permits, permissions or insurance required for their events.

15. Social and Community Features

Perfect Links Fitness may permit users to upload or share photos, videos, stories, comments, fitness activities, workout results, routes, achievements, messages, reviews, profile information, and other material (collectively, “User Content”).

You retain ownership of your User Content.

By posting User Content through the Services, you grant Perfect Links Fitness a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute and technically modify that content as reasonably necessary to operate, improve and promote the Services, subject to applicable law and our Privacy Policy.

You represent that you have the rights necessary to upload the content you submit.

16. Prohibited Content and Conduct

You may not use Perfect Links Fitness to:

• Harass, threaten or stalk another person
• Promote violence or credible threats
• Post unlawful discriminatory or hateful content
• Exploit or endanger minors
• Impersonate another person
• Commit fraud
• Distribute malware
• Attempt unauthorized access to accounts or systems
• Scrape the Services without authorization
• Manipulate challenges, rankings, XP or achievements
• Spam users
• Post content that violates intellectual-property rights
• Sell prohibited or illegal goods
• Engage in illegal activity
• Circumvent platform security
• Abuse reporting or moderation systems

Perfect Links Fitness may investigate suspected violations and restrict, suspend or terminate accounts when reasonably necessary to protect users, the platform or comply with law.

17. Direct Messages and User Interactions

Perfect Links Fitness may provide private or direct messaging.

Users are responsible for their communications and interactions with other users.

Do not send harassment, threats, unsolicited commercial messages, illegal material or other prohibited content.

Where permitted by applicable law and consistent with our Privacy Policy, Perfect Links Fitness may use automated systems and reports to identify abuse, fraud, spam or safety concerns.

18. Challenges, XP, Levels, Badges and Rewards

Perfect Links Fitness may provide virtual achievements including XP, levels, badges, streaks, wins, losses or similar rewards.

Unless expressly stated otherwise, virtual achievements have no cash value, are not currency, cannot be exchanged for cash, cannot be transferred or sold, and do not constitute property rights.

Perfect Links Fitness may adjust scoring systems, correct errors and remove achievements obtained through manipulation, fraud or technical exploits.

19. Advertising and Sponsored Content

Perfect Links Fitness may display advertisements, promotions, affiliate offers and sponsored content.

Sponsored or advertising relationships will be identified where required by applicable law.

The presence of an advertisement does not necessarily constitute Perfect Links Fitness’s endorsement of the advertiser or its products.

20. Payments

Purchases may be processed by Perfect Links Fitness or third-party payment processors.

You agree to provide accurate billing information and authorize charges associated with purchases you approve.

Applicable taxes, delivery charges, marketplace fees or other charges will be disclosed as required during the transaction.

21. Refunds

Refund eligibility depends on the product or service purchased, applicable law, the relevant refund policy and, when applicable, the rules of a third-party marketplace.

Certain digital products or services may become non-refundable once delivered or used to the extent permitted by law.

Nothing in these Terms limits refund rights that cannot legally be waived.

22. Intellectual Property

The Perfect Links Fitness platform and its software, trademarks, logos, designs, graphics, interfaces, text and other proprietary materials are owned by Perfect Links Fitness or its licensors and are protected by applicable intellectual-property laws.

Except as expressly permitted, you may not copy, modify, distribute, sell, license, reverse engineer or create derivative works from our proprietary materials.

“Perfect Links Fitness,” associated logos and other PLF branding may not be used without authorization.

23. Copyright Complaints

Perfect Links Fitness respects intellectual-property rights.

If you believe material available through the Services infringes your copyright, you may submit a copyright complaint containing the information required under applicable law.

Perfect Links Fitness may remove allegedly infringing material and may terminate repeat infringers where appropriate.

24. Privacy

Your privacy is important to us.

Our collection, use, disclosure and protection of personal information are described separately in the Perfect Links Fitness Privacy Policy.

Because fitness, location and potentially health-related information can be particularly sensitive, users should review the Privacy Policy carefully before enabling these features.

25. Security

We use reasonable administrative, technical and organizational safeguards designed to protect information and systems.

However, no internet service or electronic storage system can guarantee absolute security.

Users are responsible for securing their passwords, devices and connected accounts.

26. Service Availability

We work to provide reliable Services but cannot guarantee uninterrupted or error-free operation.

The Services may occasionally be unavailable because of maintenance, upgrades, technical problems, third-party outages or circumstances beyond our reasonable control.

27. No Guarantee of Results

Perfect Links Fitness does not guarantee that use of the Services will result in weight loss, muscle gain, improved athletic performance, specific health outcomes, specific financial savings, insurance reimbursement, achievement of fitness goals, employment or professional opportunities, or particular social or business results.

Individual outcomes vary.

28. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

PERFECT LINKS FITNESS DISCLAIMS WARRANTIES THAT MAY LEGALLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

29. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PERFECT LINKS FITNESS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO THE SERVICES.

Certain jurisdictions do not permit particular liability limitations. In those jurisdictions, these limitations apply only to the extent permitted by law.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

30. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Perfect Links Fitness and its affiliates, officers, directors, employees and agents from third-party claims, damages, losses and reasonable expenses arising from your unlawful use of the Services, violation of these Terms, or infringement of another person’s rights.

31. Account Suspension and Termination

You may stop using Perfect Links Fitness at any time.

Perfect Links Fitness may restrict, suspend or terminate access when reasonably necessary because of material or repeated violations of these Terms, fraud or suspected fraud, safety threats, illegal activity, abuse of other users, security threats, or legal or regulatory requirements.

Where appropriate and legally required, we may provide notice or an opportunity to appeal an enforcement decision.

32. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY BECAUSE IT MAY AFFECT YOUR LEGAL RIGHTS.

To the extent permitted by applicable law, you and Perfect Links Fitness agree to attempt to resolve disputes informally before initiating formal proceedings.

If a dispute cannot be resolved informally, the parties may agree to resolve covered disputes through binding individual arbitration rather than litigation in court, except for claims eligible for small claims court and other disputes that applicable law does not permit to be arbitrated.

Any arbitration provision will be interpreted and enforced subject to applicable federal and state law.

Where required by law, users will receive an opportunity to opt out of arbitration within the period and through the method specified by Perfect Links Fitness.

Nothing in these Terms prevents either party from seeking emergency or injunctive relief where legally available.

33. Governing Law

To the extent permitted by applicable law, these Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Mandatory consumer-protection rights available under the laws of a user’s jurisdiction remain unaffected where they cannot legally be waived.

34. Changes to These Terms

Perfect Links Fitness may update these Terms as the Services evolve or as legal, regulatory or operational requirements change.

When changes are material, we will provide notice as required by applicable law.

The updated Terms will display a revised “Last Updated” date.

Where legally required, we will request renewed consent before material changes become effective.

35. Electronic Communications

By using Perfect Links Fitness, you consent to receive electronic communications related to your account, transactions, security and the Services.

Marketing communications will be handled according to applicable law and your communication preferences.

36. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

37. Entire Agreement

These Terms, together with incorporated policies and any additional terms presented for specific Services, constitute the agreement between you and Perfect Links Fitness concerning your use of the Services.
